James Martin Harvey Jr.

James Martin (Marty) Harvey, Jr. practices law in Barnwell, SC where he opened his office in 1991 and founded the firm of Harvey Law Office LLC in 1996. He is admitted to the South Carolina Bar, the United States Fourth Circuit Court of Appeals, and the United States District Court for the District of South Carolina. He is a certified circuit court mediator. His practice focuses on real estate transactions as well as litigation that involves real estate – partition and quiet title cases, boundary line disputes, delinquent tax sale challenges, and eminent domain. Marty also practices in the United States Bankruptcy Court for the District of South Carolina and also devotes time to estate planning and municipal and local government law. He served on the South Carolina Bar House of Delegates from 1999 until 2011.


Marty is a native of Allendale County. He attended public schools in Barnwell and later earned a Bachelor of Arts degree (cum laude) in political science from the University of South Carolina in 1978 and a Juris Doctor degree from the University of South Carolina in 1981. While in school, he was selected to a number of honorary fraternities and organizations, including Phi Beta Kappa, Omicron Delta Kappa, and the Order of Wig and Robe. After law school, he served for a year as judicial law clerk for the Hon. Rodney A. Peeples, and then was in private practice with Blatt and Fales until 1987 and Speights & Runyan until 1991.


He has served as a Special Referee for Barnwell, Bamberg, Aiken, Allendale, and Hampton Counties since 1982, and has presided over more than 1,400 cases. He has served as Town Attorney for the Town of Allendale since 1995 and has been required to become familiar with local government and municipal law, business law, labor relations, law enforcement, eminent domain, tax execution procedure, and bonded indebtedness.


He has served in a special counsel capacity for the City of Aiken and both Hampton County and the Town of Hampton when their standing attorneys have had conflicts of interest. These matters involved police departments, tax sale litigation, and economic development matters. He has served as a civil circuit court mediator in litigation involving zoning and eminent domain between municipal governments (the City of Aiken, the City of Walterboro, and the Town of Varnville) and private citizens.


He currently serves on the City of Barnwell Board of Zoning Appeals. He has been active in service to his community of Barnwell, being elected to the Barnwell School District 45 Board of Trustees in April 2002 and serving until 2008, including chairman from April 2005 to 2008. He has served as a member of the board of directors of a number of charitable organizations in his community, including the Barnwell Baseball Association and the Barnwell Soccer Club, both of which he founded. He is a member of Harmony Lodge 17, AFM. He has been married to the same spouse for 38 years, and together they have three adult children, each of whom graduated from Barnwell High School and have earned bachelor's degrees from South Carolina institutions of higher learning.
